1. Introduction
Welcome to the YourSpot application, owned and operated by YourX Zayan Software (hereinafter referred to as "the Company" or "we").
We value your privacy and strive to protect your personal data while you use our application, website, or any related services.
This policy explains how we collect, use, and share your data, as well as your rights to control it.
By using the YourSpot application, you acknowledge that you have read, understood, and agree to this policy.
2. Policy Scope
This policy applies to all users of the YourSpot application, whether they are:
Regular users (customers searching for places or experiences).
Sellers or service providers (Partners).
Visitors to the website or users of related services (API, Mini Apps, etc.).
3. Data We Collect
We collect two types of data:
(a) Data provided voluntarily by the user:
Name, email address, phone number.
Profile picture or business logo.
Your geographical location (if you permit it).
Payment data or bank account information (when conducting financial transactions).
Official documents (such as ID card or commercial registration for partners).
(b) Data collected automatically:
Device type, operating system, and application version.
IP address and approximate location.
Usage data (pages visited, session duration, clicks).
Unique identifiers (Firebase ID, Device ID, Advertising ID).
(c) Data from third parties:
We may obtain data from partners such as payment gateways or social networks when you log in or make payments.
4. Use of Data
We use your data for the following purposes:
1. Operating and improving application services.
2. Personalizing the experience and providing recommendations and places that match your preferences.
3. Managing accounts, bookings, and payment processes.
4. Communicating with you regarding notifications, updates, or offers.
5. Analyzing performance and statistics for service development purposes.
6. Protecting users and preventing fraudulent or illegal activities.
7. Complying with legal and regulatory obligations.
5. Data Sharing
We may share your data with the following parties when necessary only:
Electronic payment partners (such as Paymob or Fawry).
Technical service providers (Firebase, Cloud Functions, analytics).
Government entities when legally requested.
Sellers (Partners) in case you make a booking or interact with them. In such cases, we share only the necessary information (such as your name and phone number) required to complete the booking or transaction. This data is shared solely for the purpose of fulfilling the service and is not used by partners for marketing purposes without your explicit consent.
We confirm that we do not sell your personal data to any third party under any circumstances.
7. Liability Limits in Case of Breach or Malfunctions
Despite YourX Zayan Software taking all necessary technical and administrative measures to protect user data and secure YourSpot application systems,
the user acknowledges and understands that any electronic system is theoretically vulnerable to breach, malfunction, or unauthorized access due to factors beyond complete human or technical control.
Accordingly:
1. The Company shall not be liable for any direct, indirect, or consequential loss or damage arising from a security breach, data leak, or temporary or permanent service interruption.
2. In case of a security incident, the Company will immediately take the following measures:
Assess the impact level and attempt to contain the breach.
Notify affected users (via email or in-app notification).
Cooperate with relevant legal authorities if required.
3. The user acknowledges that they use the application at their own risk, and the Company does not guarantee uninterrupted service continuity or freedom from technical errors or breach attempts.
4. As the Merchant of Record, YourSpot directly provides the electronic booking and payment services to the user. The Partners act strictly as authorized fulfillment partners responsible for the actual on-ground service delivery (e.g., food quality, safety, and hospitality). While YourSpot manages the booking transaction, any disputes specifically regarding the physical on-site experience or product quality must be addressed with the fulfillment Partner.
8. Data Retention
We retain your data as long as your account is active or as required by laws or technical necessities.
You can request deletion of your account or data at any time through settings or by contacting us.
9. Your Rights as a User
You have the following rights:
1. Access your personal data stored with us.
2. Correct or update your data.
3. Request permanent deletion of your data (unless required by law).
4. Unsubscribe from marketing notifications.
5. Know how we use your geographical location or advertising data.
10. Privacy of Minors
The YourSpot application is intended for users (13 years or older).
If we become aware that we have collected data from a user under 13 years of age without parental consent, we will delete it immediately.
11. External Links and Services
The application may contain links to external applications or websites that we do not control.
We are not responsible for the privacy policies or practices of those sites.
Please review their policies before using them.
12. Cross-Border Data Transfer
Your data may be stored or processed on servers outside the Arab Republic of Egypt.
By using the application, you agree to this transfer with the assurance that appropriate protection standards will be applied.
13. Terms of Service Updates
We may update these terms from time to time.
You will be notified through the application or email before changes take effect.
Changes may include updates to service fees, booking fees, pricing policies, subscription plans, or other terms and conditions.
YourSpot reserves the right to adjust fees, introduce new subscription tiers, or modify pricing structures with prior notice through the application or website.
Your continued use of the application after the update means you agree to it.

15. Consent
By using the YourSpot application or registering an account with us, you explicitly agree to these terms of service and acknowledge that you have read and understood them in full.
16. Pricing and Service Fees
The prices displayed in the YourSpot app are set by partners and include all applicable taxes (if any).
YourSpot does not add any hidden commissions or markups to the displayed prices.
However, the app may charge small non-refundable service or booking fees when making reservations or pre-orders. These fees are clearly shown before checkout and are only refundable if the booking is canceled by the partner or fails due to a system issue.
Service fees and booking fees may vary depending on the type of activity or partner (e.g., café reservations, activity bookings, pre-orders, etc.).
Fees may be adjusted or waived based on your subscription plan (Free, Pro, YS+). Subscription plans may offer reduced fees, priority booking, or other benefits as outlined in the subscription terms.
YourSpot reserves the right to adjust these fees, introduce new subscription plans, or modify pricing structures in the future with prior notice through the app or website.
17. YourSpot Wallet Balance
"YourSpot Wallet Balance" is a digital (virtual) representation of payments made through our licensed payment service provider partners (such as Paymob).
Actual funds are stored and managed by the licensed party, while the corresponding value is displayed within the app solely for the purpose of facilitating internal transactions.
YourSpot does not actually hold funds, and is not considered a financial or banking services provider.
**Prepaid Wallet Operational Policies & Constraints:**
1. **Prepaid Model:** This wallet operates strictly on a Prepaid Model (similar to charging points/credits).
2. **Exclusively Dedicated Use:** The wallet balance is exclusively dedicated for transactions inside the YourSpot platform.
3. **Cashout Prohibition:** Cashing out, withdrawing, or transferring any loaded funds or earned Cashback back to a bank card, mobile wallet, or cash is ABSOLUTELY PROHIBITED under any circumstances.
4. **Cashback Re-use:** Cashback balances can only be re-used to book subsequent venues or premium activities inside the application.
5. **Cashback Calculation:** Cashback is calculated on the subtotal of the order/booking only, excluding VAT, service charges paid at the spot, and alcoholic beverages.
18. Cancellation & Refund Policy
**Order Types & Non-Refundable Fees:**
1. **Pickup Orders:** Menu items + app fee (NO booking fee, NO VAT)
- App fee is NON-REFUNDABLE on cancellation
2. **Table Bookings:** Booking fee + VAT (NO menu items)
- Booking fee is NON-REFUNDABLE on cancellation
3. **Booking with Pre-Order:** Menu items + booking fee + VAT
- Booking fee is NON-REFUNDABLE on cancellation
**Note:** Fee amounts may vary by partner/spot. Exact fees are displayed before payment.
**User Cancellation Before Partner Accepts:**
- Pickup Orders: 100% refund of menu items (app fee kept)
- Table Bookings: No refund (booking fee kept)
- Booking + Food: 100% refund of menu items (booking fee kept)
**User Cancellation After Partner Accepts (Time-Based):**
- 24+ hours before: 100% refund of refundable amount
- 4-24 hours before: 50% refund of refundable amount
- Less than 4 hours: No refund
**Partner Rejects Booking:** 100% full refund including all fees
**Partner Cancels After Accepting:** 100% full refund to user including all fees
**No-Show & Account Restrictions:**
- Failing to arrive within the scheduled booking window will result in a penalty that increases your account's **"Abuse Score"**.
- Your account may be restricted from making new bookings or using certain platform features if this score becomes high.
- Correcting this behavior by consistently honoring future bookings and completing them successfully will help improve your score and restore full access over time.
**Important Notes:**
- ✅ All refunds are processed **instantly to your YourSpot wallet only**
- ❌ Refunds **cannot be withdrawn** to bank accounts or cash
- ✅ Wallet balance can be used for **future bookings and orders only**
- 💰 Refunds appear in your wallet within seconds

19. Pre-Order Wait Times
For certain menu items or specific time slots, a 'Preparation Time' may be required. If you choose to proceed with an order by accepting this wait time (e.g., clicking 'Order Anyway'), you explicitly acknowledge and agree that your order will be prepared within the specified timeframe, even if it exceeds standard delivery or pickup windows. You agree to wait for the duration specified at the time of order placement.
